Introduction

Welcome to GameFlight, created by Into the Unknown Sp. z o.o. (LLC) (registered address: Partyzantów 27/5, 80-254, Gdańsk, Poland; KRS number: 0000690415; NIP (Tax ID No.): PL957-109-69-89; REGON (Statistical ID No.): 367981077; further referred to as "ITU").

These Terms of Service apply to everyone who visits, uses, or seeks to use and/or access the Service. By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions.

Definitions

• • Backer: A user who supports a project financially, often receiving rewards based on their contribution.

  • Pledge: The amount of money a backer commits to a project, charged either immediately or at the end of the fundraising period.

  • Website: The GameFlight website and services.

  • Project: A campaign to raise funds for a specified goal, managed by an individual or organization. Updates are provided to backers.

  • Services: All features, tools, and functionalities offered by GameFlight, including pledge management and online transactions.

  • Shipping Wave: A batch in which orders are processed and sent to backers, organized by production schedules.

  • Terms: The rules governing platform use, user conduct, project creator responsibilities, and dispute resolution.

  • Users: All individuals with accounts who browse and/or create Projects and/or make pledges.

  • Creator: Users that create and manage Projects.

Use of the Website

• Users must be at least 18 years old or have parental consent to use our services.
• Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
• Users need to log in to use the Services. They can:
  • Browse the Website
  • Edit account data
  • Support Projects
  • Buy or sell Goods
  • Comment on Projects
  • Receive newsletters
  • Learn about trending Projects
• To stop receiving newsletters and updates, users should adjust their account settings. By default, creating an account generates a public profile page that includes:
  • Nickname
  • Avatar
  • Profile description
  • Supported or followed projects
• Personal information such as name, birth date, payment details, IP address, pledge amounts, rewards, identity verification documents, and direct communications with GameFlight will not be publicly displayed.
• Using the Website involves various roles, such as crowdfunding participation, pledge management, and online transactions. Each role has specific responsibilities and may need additional information and acceptance of distinct terms of service.
• Creating account and using the Website is free, but some services may incur fees or require additional actions, which will be communicated beforehand.
• Due to data transmission via the public Internet, there is a risk of unauthorized third-party interference in the data exchanged between GameFlight and Users.
• Users may delete their accounts anytime via settings, terminating the Agreement. GameFlight can suspend or delete accounts for any breach of terms or legal issues, notifying Users via email. Certain User data may be retained as required by law or for legitimate purposes.

Product Orders

• Pricing: All prices are listed in project’s currency and are subject to change. Prices on the Platform constitute commercial information, not an offer within the meaning of the Polish Civil Code.
• Payment: All relevant payments must be received before products are shipped. That includes costs of items, shipping and any other standing fees or taxes. 
• Shipping: Shipping times and costs vary based on location and will be provided at checkout. More relevant information on the topic should be included on Creator’s update page.

Intelectual Property

The services and products on the Website are protected by copyrights, trademarks, patents, and trade secrets. Users must respect all legal notices accessed through the Website. User-published materials must not infringe on others' rights.

To report copyright infringement, please send us a message at [email protected] with relevant details, including proof of ownership and a description of the alleged infringement. We will review the claim and take appropriate action.

If a User's actions result in legitimate claims against GameFlight for infringement, the User agrees to handle the matter at their own expense and protect GameFlight. This includes participating in proceedings and compensating GameFlight for incurred costs, including legal fees and amounts payable due to judgments or settlements.

Limitations of Liability

GameFlight is not liable for any website interruptions or data loss caused by force majeure, third parties, or efforts to improve functionality.

Users must keep their account information confidential and are responsible for activities under their account.

Prices on the Website are not offers as defined by the Polish Civil Code but are commercial information.

The contract between Users and their counterparts governs their relationship. GameFlight is not a party to these contracts and is not responsible for actions, omissions, breaches, project timelines, reward delivery, or product sales. Payments go directly to Creators and Sellers, who determine refund terms individually.

For issues, Users should contact the relevant party. If unresolved, they may seek assistance directly from ITU.

GameFlight is not liable for service providers needed to perform the Agreement, as permitted by Polish law.
